Condominium Associations are legal entities responsible for managing and maintaining condominium properties. The Board of Directors, elected by the unit owners, is responsible for the overall management of the corporation. As part of their responsibilities and as per the Condominium Property Act, the Board of Directors must ensure that they are registered and updated with Alberta Land Titles. 1

A corporation shall, within 30 days from the conclusion of the corporation’s annual general meeting, file at the land titles office a notice in the prescribed form stating the names and addresses of the members of the board.

If a change occurs between elections (for example, a board member vacancy or removal), the condominium corporation must promptly file it at the Land Titles Office.

Ensuring the current Board of Directors are registered with Alberta Land Titles is important for several reasons, including:

1. Legal Ownership and Control of the Property

Registering the Board of Directors with Alberta Land Titles ensures that they are recognized as the legal owners of the property. This is important for legal and financial purposes. It also ensures that the Board has control over the property and can make decisions regarding its management and maintenance.

2. Access to Property Information

Registering with Alberta Land Titles provides the Board of Directors with access to important property information. This includes information about the property’s boundaries, legal descriptions, and any liens or encumbrances that may exist. This information is crucial for making informed decisions about the management of the property.

3. Protection of the Property’s Value

Ensuring that the Board of Directors is registered and updated with Alberta Land Titles helps to protect the value of the property. This is because it ensures that the Board has the legal authority to make decisions about the management and maintenance of the property. It also helps to prevent disputes or legal issues that could negatively impact the property’s value.

4. Compliance with Legal Requirements

There are legal requirements through the Condominium Property Act that must be met when registering changed with the Board of Directors with Alberta Land Titles. These requirements include providing the name of the Board member and address of the Board member. Ensuring that the Board of Directors is registered and updated with Alberta Land Titles helps to ensure that the corporation is in compliance with all legal requirements.

5. Facilitating the Sale of Units

When a unit owner decides to sell their unit, the Board of Directors must provide certain information to the buyer. This includes information about the corporation’s financial status, management, and any outstanding issues related to the property. Ensuring that the Board of Directors is registered and updated with Alberta Land Titles helps to facilitate the sale of units by ensuring that this information is readily available.

In conclusion, registering and updating the Board of Directors with Alberta Land Titles is a crucial aspect of managing a condominium corporation. It ensures that the Board has legal ownership and control of the property, access to important property information, and can make informed decisions about the management and maintenance of the property. Notes:

  1. Registration of the Notice requires time and the time for registration could take weeks (or even months).
  2. The cost of filing the Notice of Change of Directors is paid by the Corporation. The administrative fee for preparing and filing the notice for the first Change following an election is included in your contract. Fees apply for additional notices.
